July 08, 2013–Work on the Hyatt Place hotel in Amherst will continue after a state judge turned away a request by neighbors to stop the project.

State Supreme Court Justice Paula L. Feroleto late Tuesday denied a request for a temporary restraining order made by nearby residents who oppose the project.

Neighbors said they filed the request after seeing Iskalo Development in recent days begin tree-clearing and other site work near Main Street and the I-290.

They oppose the project on the grounds that the six-story hotel will alter the character of the surrounding residential neighborhood, and multiple legal challenges are working their way through the courts.

David Chiazza, executive vice president of Iskalo Development, said the judge “made an appropriate ruling.”

Attorney Richard G. Berger, who represents the residents, did not immediately respond to messages left for comment.

But there are other ways the residents could halt the $15 million project, including seeking an injunction.

Those measures, though, are believed to be more difficult to secure than the restraining order they failed to get.
